Over my many years in this business I have come across commercial lease agreements that range anywhere from a one page document to over 200+ pages.

 

Lease Agreements

 

When dealing with commercial leases, be it for industrial property, retail or commercial space, a  lease is not a simple form where you fill in the blanks to accommodate everyone’s needs. A properly written lease should be specific to the type of lease space being leased and reflect the negotiated details between the Landlord and Tenant.

 

As with any contractual agreement it is always advisable to seek advice from a lawyer. Some forms of lease agreements can be worded in unfamiliar legal terminology. DO NOT SIGN SOMETHING THAT YOU DON’T UNDERSTAND – pleading ignorance after the fact when something goes wrong won’t do you or your business any good.

 

There are a few key items that each and every lease will need to detail;

 

·    Property description, address, legal description, possibly even a map or photo of the site,

·    Names, addresses and contact information for the Tenant and the Landlord,

·    The  term of the lease,

·    Lease rate(s) and payment schedule,

·    Actual terms and conditions of the lease,

·   Authorized signatures of the Tenant and Landlord.

 

These basic items need to be combined with the specific details pertaining to the negotiated terms and conditions. They will cover concerns such as; insurance and liability, improvements, repairs and maintenance,  remedies for both the Tenant and Landlord should any of the terms and conditions not be fulfilled just to name a few.
